I created this indicator that paints red and green on the chart when the conditions are met
But the colors appear in the lower part of the graph within the other indicators
How do I plot the colors only on the top chart only?

Well, then that's your problem then. It says "for the background colors for all panels".

Use BackBrushes instead:
