last price greater then high of bar

I don't quite understand. Shouldn't the last tick of the last bar be actually the start of the new bar if its the same price? Is the same tick being used twice?

The same tick is not being used twice. The new tick has the same price level as the prior tick. A tick is needed to close the prior bar and a new tick for the new bar can still have the same price as the prior tick.

I was not being clear. What you ask in the quote above is what is occurring. The new tick of the new bar opens the new bar confirming the close of the prior bar, that is not to say that it is used in the prior bar.
