CME Non Display policy

I understand this came about in 2014 -
Are these fees being enforced on individual traders that develop automated trading strategies?
What is the criteria to enforce? How do they enforce this 375 a month?
I have searched a lot of forums of platforms that have automated capability, yet I can't find any discussions
